Colmanac Terms of Use

Colmanac provides informational tools, scanner functionality, collection and watchlist features, analytics, indexes, market data, price estimates, dashboards, news, affiliate links, and subscription features related to collectibles. We may add, remove, suspend, limit, rename, price, or change features at any time.

You must be at least 18 years old, or the age of majority where you live, and capable of forming a binding contract to use Colmanac without parent or guardian involvement. If you use Colmanac for or on behalf of another person or entity, you represent that you have authority to bind them.

You are responsible for your account, password, devices, email account, and all activity under your credentials. Information you provide must be accurate and kept current. We may refuse, suspend, restrict, or terminate accounts or access where we reasonably believe these Terms, law, security, or third-party rights may be violated.

When you create an account, you must accept these Terms, the Privacy Policy, the Cookie & Similar Technologies Policy, and the Disclaimer. Your acceptance may be recorded with your user ID, email hash, timestamp, IP address, country, user agent, document version, and related metadata for legal, security, and audit purposes.

Marketing consent is optional and separate from acceptance of the user agreement. You can withdraw marketing consent at any time through available settings, unsubscribe links, or by contacting us.

Colmanac may offer paid features, including a subscription called Super. Purchase screens will show the then-current price, billing period, trial terms, renewal terms, taxes where applicable, and platform/provider information before purchase. Prices, features, availability, trials, currencies, taxes, and plans may vary by country, platform, store, and user eligibility.

Subscriptions renew automatically unless cancelled before the renewal date. Web subscriptions may be managed through Colmanac account settings or the relevant payment provider portal. iOS subscriptions are managed through Apple. Android subscriptions are managed through Google Play. Deleting the app or account does not necessarily cancel an active subscription; you must cancel through the purchase provider where required.

Refunds, cancellations, chargebacks, billing support, statutory cancellation rights, and purchase disputes are handled under applicable law and the rules of the provider or app store that processed the purchase. We may change subscription features, prices, plan names, trials, or availability, and will provide notice where required.

Colmanac is an independent resource. We are not affiliated with, endorsed by, sponsored by, authorized by, or officially connected with Pokemon, The Pokemon Company, Nintendo, Wizards of the Coast, eBay, Fanatics, Goldin, PSA, CGC, Beckett, TCGplayer, Cardmarket, Amazon, or any other brand, marketplace, manufacturer, publisher, grading company, artist, rightsholder, or third party mentioned in the Service unless expressly stated.

Names, logos, images, trademarks, product names, set names, characters, and other references are used for identification, commentary, informational, compatibility, marketplace, or descriptive purposes only. All third-party rights remain with their respective owners.

The Service is for informational and personal-use purposes only. Nothing in the Service is financial, investment, legal, tax, accounting, insurance, appraisal, grading, authentication, professional, or fiduciary advice. Nothing is an offer, recommendation, solicitation, or guarantee to buy, sell, grade, insure, value, hold, or invest in any collectible, asset, product, or service.

You are solely responsible for your decisions and should independently verify information and consult qualified professionals before acting.

Colmanac uses public, marketplace, user-provided, licensed, commercial, and third-party data points. Those data points may be delayed, incomplete, inaccurate, inconsistent, duplicated, misclassified, stale, unavailable, or changed without notice. Public listing and marketplace data may not represent completed sales, realizable prices, condition, authenticity, fees, taxes, shipping, returns, or fraud risk.

Our scanner matches, prices, charts, trends, indexes, collection values, watchlist values, expected value outputs, graded profit estimates, deal finder results, and other analytics are estimates and may be wrong or out of date. We do not guarantee accuracy, completeness, timeliness, reliability, availability, non-infringement, or fitness for any purpose.

You must not rely on Colmanac data as definitive evidence for purchases, sales, taxes, insurance, lending, accounting, disputes, appraisals, legal proceedings, or investment decisions. Use the Service at your own risk.

The Service, software, source code, design, branding, layouts, compilations, databases, selection and arrangement of data, data cleaning, normalization, deduplication, enrichment, ranking, weighting, scoring, indexing, matching, scanner outputs, methodologies, models, signals, charts, pricing estimates, derived metrics, and all related intellectual property are owned by Colmanac Limited or its licensors and are protected by copyright, database rights, trade secret, trademark, contract, and other laws.

You receive a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, lawful, non-commercial use in the ordinary intended interface. No ownership rights or implied licenses are granted.

You must not copy, reproduce, scrape, crawl, harvest, mine, extract, bulk download, cache, monitor, mirror, frame, syndicate, redistribute, resell, sublicense, publicly display, benchmark, reverse engineer, train models on, enrich competing datasets with, or create derivative commercial products from Colmanac data, outputs, pages, APIs, screenshots, scanner outputs, databases, or services without our prior written consent.

You must not use Colmanac to build, train, evaluate, benchmark, operate, or enrich any competing product, pricing tool, analytics system, marketplace service, model, database, API, spreadsheet, internal tool, or commercial service. You must not bypass access controls, rate limits, paywalls, robots controls, authentication, technical restrictions, or security measures.

Limited personal screenshots shared on social media are permitted if they are not misleading, do not reveal private account data, and clearly attribute Colmanac.

If you submit or store information in Colmanac, including collection data, watchlist data, notes, prices, profile images, support messages, bug reports, or feedback, you represent that you have the right to do so and that it does not violate law or third-party rights.

You retain any rights you have in your user content, but grant Colmanac a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, reproduce, display, modify, analyze, create derived insights from, and otherwise use that content as needed to provide, secure, improve, and operate the Service and enforce these Terms.

Feedback, suggestions, and ideas may be used by Colmanac without restriction or compensation.

Scanner and image features may produce incorrect matches or no match. You are responsible for verifying any result. Native and web scanner behavior may differ by device, camera, lighting, model version, browser, operating system, and network conditions.

Raw camera frames and cropped card images used for scanner matching are intended to remain on-device. Derived model outputs may be sent to Colmanac where required by the scanner API contract. Profile images or other images you intentionally upload may be stored and processed to provide that feature.

The Service may link to third-party listings, marketplaces, advertisers, affiliate partners, app stores, payment providers, grading companies, social platforms, and other sites or services. We may earn commissions on qualifying purchases or referrals.

Third parties are responsible for their own products, listings, fulfillment, shipping, taxes, fees, availability, prices, returns, refunds, data, terms, policies, privacy practices, and security. Links, ads, rankings, deal results, or affiliate placements are not endorsements or recommendations.

You must not misuse the Service, interfere with its operation, attempt unauthorized access, attack or probe systems, introduce malware, impersonate others, create fraudulent accounts, abuse trials or promotions, submit unlawful content, infringe rights, violate marketplace or app-store rules, or use the Service for unlawful, deceptive, harmful, or commercial extraction purposes.

Our Privacy Policy and Cookie & Similar Technologies Policy explain how data is collected and used. Service, security, billing, account, and legal notices may be sent even if you opt out of marketing. Marketing communications require consent where applicable and can be withdrawn.

The Service is provided "as is", "as available", and "with all faults". To the fullest extent permitted by law, Colmanac Limited disclaims all warranties, representations, guarantees, and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, up to date, complete, compatible with every device, free from harmful components, or that any output will meet your needs or prevent losses.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or statutory rights that cannot be waived.

To the fullest extent permitted by law, Colmanac Limited and its directors, officers, employees, contractors, licensors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for loss of profits, revenue, business, opportunity, goodwill, data, use, savings, reputation, or collectible value, arising from or related to the Service.

To the fullest extent permitted by law, our total aggregate liability for all claims arising from or related to the Service is limited to the greater of (a) GBP 100 or (b) the amount you paid directly to Colmanac for the Service in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold harmless Colmanac Limited and its directors, officers, employees, contractors, licensors, service providers, and partners from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from your use of the Service, your content, your decisions, your violation of these Terms, your violation of law, or your infringement of third-party rights.

We may suspend, restrict, or terminate access to all or part of the Service at any time where we believe it is necessary for security, legal compliance, business reasons, non-payment, misuse, breach of these Terms, third-party rights, or protection of Colmanac or users. You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including intellectual property, data restrictions, disclaimers, liability limits, indemnity, governing law, and audit provisions.

We may update these Terms from time to time. Material changes will be indicated by updating the effective date and, where required, additional notice. Continued use after changes take effect constitutes acceptance of the updated Terms where permitted by law.

These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except where applicable consumer protection law gives you rights to bring claims elsewhere or prevents this choice of law or venue from applying.
